COUNTER AFFIDAVIT TO APPLICATION U/S 16(1) OF THE SINDH RENTED PREMISES ORDINANCE (SRPO), 1979

That being the opponent in the above matter, I am well conversant with the facts of the case.

That I have read and fully understood the contents of Application filed under section 16(1) of the Sindh Rented Premises Ordinance (SRPO),1979 by the applicant and its accompanying affidavit and hereby deny all such allegations, assertions and averments contained therein, which are contrary to my Counter Affidavit (“the Counter Affidavit”) and unless specifically admitted hereinafter.

That I have been advised by my Counsel which I advise verily believe to be true that the Application filed by the applicant is misconceived and not maintainable under the law and same is liable to be dismissed.

That for brevity sake I crave leave of this Hon’ble Court to adopt the contents of my Written Statement which may please be treated as integral part of this affidavit.

PRELIMINARY OBJECTIONS:

That the applicant has no cause of action to institute and maintain the instant suit.

That the applicant has not come with clean hands before this Hon’ble Court and the allegations contained in the plaint are baseless and malicious against the opponent in order to pressurize and blackmail him.

That the Applicant has committed perjury by making false statement under oath to misguide this Hon’ble Court.
